General and Particular Conditions of Contract of CONSIGNIAS Y LOCKERS S.L.

Object

These general and specific terms and conditions govern the rental of lockers owned by the entity CONSIGNIAS Y LOCKERS, S.L. through the website www.Belockal.com, as well as via the touchscreen located at the commercial premises in Seville, Calle Almirantazgo, 9, and their use. Additionally, these terms and conditions regulate the contractual relationship between CONSIGNIAS Y LOCKERS, S.L. (owner of the Belockal lockers) and the User who contracts the Belockal locker service.

The parties will be referred to interchangeably as Belockal and User or Client.

The service

BELOCKAL offers its Users the possibility to rent any of its lockers for periods of calendar days (within the hours offered by Belockal).

What kind of slogans does BELOCKAL offer?

BELOCKAL offers three types of lockers:

  • Medium lockers (M), measuring 580mmX436mmX293mm. These lockers can hold approximately one cabin suitcase and a small backpack.
  • Large lockers (L), measuring 580mmX436mmX560mm. These lockers can hold approximately two cabin suitcases and a medium-sized backpack.
  • Extra-large lockers (XL), measuring 580mmX436mmX856mm. These lockers can hold approximately four cabin suitcases, or one very large suitcase, or one large suitcase and one cabin suitcase.

What can a User enter in his or her slogan?

Within the limits established in this document (see Section *Limits on the Use of Lockers*), a User may place as many items as they wish inside the rented locker(s).

How can a User find out if there are available slogans at BELOCKAL?

This information can be accessed by visiting the website www.belockal.com and starting a reservation.

For how long can the same locker be rented for?

The User may contract the locker rental service for a period ranging from 1 day as a minimum to 30 calendar days as a maximum, and this period must fall within the establishment’s opening months.

When will the User be able to access the locker(s) he/she has rented?

The rental service for each locker will be accessible during the hours indicated at the commercial premises, every day of the week, 365 days a year, from 00:00 to 23:59 of the following day. Occasionally, lockers may not be reserved or accessed when the premises where they are located remain closed for security and/or maintenance reasons.

Once the User has inserted the packages, can he/she return to the locker to retrieve them?

Once the user has placed the items in the locker, they can access it as many times as they wish, ensuring it is always emptied and securely closed at the end of the rental period.

What is the price to be paid by the User per type of locker/day?

1. Prices
The prices applicable to each product are those indicated on the website at the time of purchase. The final prices listed on the website include VAT and refer to the rental of a locker (according to its size) per calendar day (from 00:00 am to 11:59 pm).

Offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.

Belockal reserves the right to make any modifications it deems appropriate on the website and at the commercial premises at any time and without prior notice, being able to update products and services daily according to market conditions.

2. Method of payment
Purchases can be paid for using a credit or debit card through any of the methods indicated on the website at the time of booking or via the touchscreen located at the commercial premises.

How are slogans reserved and used?

The lockers offered through Belockal are fully automated.

Locker reservations can be made through the website www.belockal.com.

The User must access the website www.belockal.com and go to the reservations section. In this section, they must select the number of lockers, size, and reservation period. They must also provide their first name, last name, mobile phone number, and email address.

Once these Terms and Conditions are accepted, payment is made by card, and the reservation is completed, the User will receive confirmation of the reservation, the locker number(s), and the security code to access both the premises and their locker(s) via email and/or SMS on their mobile phone.

On the day of the reservation, at the commercial premises’ entrance, the User must enter the code sent via email and/or SMS when making the reservation on the touchscreen next to the main entrance. If the code is correct, the main door will open, allowing the User to access the premises.

Once inside, the User must go to the touchscreen located on one of the lockers and re-enter the reservation code. If the code is correct, the rented locker will open automatically.

The User can only access their locker using the security code provided via email and/or SMS sent to the phone number provided at the time of booking. Therefore, CONSIGNIAS Y LOCKERS, S.L. is not responsible if the User incorrectly provides this information during the booking process and fails to receive the security code for reasons attributable to the User.

Once the reservation number entered on the touchscreen is confirmed, the assigned locker will open automatically, allowing the User to store their luggage or other permitted items. The locker must be closed each time it is opened, even when the User permanently removes their belongings.

What should the User do when he/she wants to finalise the booking?

When the User wants to open the locker for any reason, the system on the touchscreen located at the premises will ask if they wish to open it and continue the reservation (e.g., because they forgot to remove or place an item) or if they wish to open it to empty it and end the reservation.

If the User wishes to end the reservation, they must select the option to open the locker to empty it and finalize the reservation. Once the locker is emptied, it must be left closed so it is available for other customers.

If the User selects the option to open the locker to empty it and end the reservation, the system will automatically unlock the locker, making it available for reservation by other Users.

If the User has left luggage or any items inside the locker, CONSIGNIAS Y LOCKERS, S.L. will not be responsible for what the new User of the locker does with the items left by the previous User inside the locker.

What can the User do if he/she has any kind of incident in the use of the locker?

In case of a malfunction, lockout, or any other technical issue with the use of the locker, as long as it is during business hours, the User will have access to Belockal’s support service by calling +34 662 133 118. This phone number will only handle technical issues or malfunctions and not any other inquiries regarding the use of the locker.

Can the User modify or cancel his/her reservation?

Once the reservation has been made and confirmed, the User will not be able to modify or cancel it.

If the User wishes to modify their reservation after it has been made (changing dates or booking more or fewer days than originally reserved), they must cancel the reservation and make a new one.

Acceptance and acceptance testing

The purchase of products must be made through the website www.belockal.com and expresses full acceptance of each and every one of these General and Specific Terms and Conditions as they are displayed at the time on the link appearing on the website and the touchscreen, without applying any changes that may occur in the wording of the General Terms and Conditions afterwards.

From the moment of acceptance, the user acquires the status of Belockal’s Client as described in these General and Specific Terms and Conditions. Any product or service offered subsequently by Belockal will require a new contract.

Belockal informs you that it archives the electronic documents in which the purchases are formalized.

Access and booking

In order to rent Belockal lockers, the following requirements must be met:

  • Be at least 16 years old.
  • Complete the necessary details to finalize the reservation and payment.
  • Accept these General Terms and Conditions for service rental and locker use.

The User must keep the code sent to the email and/or mobile phone provided by the Client, as it will be necessary to enter the premises, open the locker, and retrieve the luggage.

Completion of the service

The service will end when the User selects the option on the touchscreen to open the locker and leave permanently. In this case, the User must remove all items from the locker and leave it closed. A charge equal to 20% of the locker rental cost will be applied to the customer’s credit/debit card if the door is left open.

By contracting the Belockal locker rental services, the User agrees, in particular and without limitation:

  • To use the lockers solely for the purpose of storing their own property that needs to be temporarily kept in a secure place.
  • To use the lockers diligently and, in particular, to ensure that the locker is properly closed when the User leaves the premises (after inserting or removing the items). If the User leaves the locker open with their belongings inside, CONSIGNIAS Y LOCKERS SL will not be responsible for any loss, theft, or damage caused.
  • Not to use the lockers for illegal or unauthorized purposes. In particular, the User agrees not to store items whose possession or trafficking is illegal (such as stolen goods, drugs, pornographic materials, or anything degrading to humans, etc.).
  • Not to deposit any goods that require a license without such a license or authorization (e.g., weapons).
  • Not to insert any type of material that is contaminating or dangerous (such as flammable objects or hazardous substances) into the lockers.
  • Not to use the lockers to store animals or any type of living or deceased being.
  • Not to insert food or beverages into the lockers, unless it is packaged food that cannot spill, stain the lockers, or produce any odors in the Belockal premises.
  • Not to share their security code with any third party, being fully responsible for any violation of this obligation and its consequences. The reservation code is personal and non-transferable and may only be used by the person who made the reservation, not being transferable to a third party when the reservation holder goes to retrieve their belongings from the premises.
  • Not to use the lockers to store items to be picked up by a third party. Lockers should not be used as a means of trafficking goods between parties. This use is not authorized by Belockal.
  • To access the premises and stay there only for the purpose of accessing the rented locker and only to carry out a specific action related to the inserted items. The User may not remain in the premises longer than strictly necessary.
  • Not to eat or drink inside the premises.
  • To remove the items inserted into the rented locker(s) when the rental period ends.
  • To leave the lockers in the same condition as found at the end of the service, and in particular, to notify Belockal via email at info@belockal.com of any issues encountered during the use or condition of the lockers.
  • Not to take photographs or videos inside the Belockal premises (except those necessary to capture the reservation/security number) and, in particular and without limitation, not to take photos or recordings of the premises’ security mechanisms.
  • To include money, jewelry, technological items (tablets, computers, televisions, etc.), or valuable goods in the lockers at their own risk, being solely and exclusively responsible for their decision to use the rented lockers to store such high-value goods.
  • To pay the locker rental fee with a credit/debit card in their name or with authorization from the cardholder.

Consequences and liability of the user in case of non-compliance with his obligations

The User must hold CONSIGNIAS Y LOCKERS, S.L. harmless for any damages arising from the breach of their obligations under this contract, both those mentioned in the previous Clause and those specified in the other clauses of the same and those arising from them.

The breach of any of these Conditions may lead to the withdrawal or cancellation of the Services by Belockal without prior notice to the Customer and without giving rise to any compensation.

Furthermore, in the event of a breach of the rental period, improper use of the lockers, and damages caused to the lockers by Users, the following will apply:

Failure to comply with the rental period:
If the User does not remove the items from the lockers within the rental period, the following rules will apply depending on the situation:

If the User does not remove the items within 30 calendar days (inclusive) from the end of the rental period: In this case, the items will remain in the rented locker, and CONSIGNIAS Y LOCKERS S.L. reserves the right to remove them and place them elsewhere. For each day that passes after the rental period has ended, without the items being collected by the User, a daily fee equivalent to the price of the uncollected locker will be charged, regardless of the right of CONSIGNIAS Y LOCKERS S.L. to claim any damages incurred.

CONSIGNIAS Y LOCKERS S.L. reserves the right to withhold the items until full payment of the outstanding amount by the User.

Furthermore, if the User requests the return of the items by shipping, the shipping cost will be fully borne by the User, and CONSIGNIAS Y LOCKERS S.L. will not assume any risk for the transportation of the items.

If the User requests shipping, the transportation costs will be paid in advance by the User before shipping. Additionally, in this case, CONSIGNIAS Y LOCKERS S.L. will charge a fee of 300 Euros plus VAT for the service provided in managing the retrieval and delivery of the items to the transport company. CONSIGNIAS Y LOCKERS S.L. reserves the right to withhold the items until full payment of the outstanding amount by the User.

  • After 31 calendar days (inclusive) from the end of the rental period, if the User has not requested the return of the items, it will be understood that the goods have been abandoned by the User for all purposes. And CONSIGNIAS Y LOCKERS S.L. MAY DISPOSE OF THEM.

In such a case, CONSIGNIAS Y LOCKERS S.L. may dispose of them as it deems appropriate, depending on the type of abandoned goods, with full indemnity for CONSIGNIAS Y LOCKERS S.L.

Non-compliance with the proper use of slogans:
CONSIGNIAS Y LOCKERS, S.L. reserves the right to remove any item that does not comply with the locker usage regulations and is considered a prohibited item. In such cases, CONSIGNIAS Y LOCKERS, S.L. is authorized to call the police or the competent authorities and report the behavior, as well as remove the prohibited items and dispose of them as deemed appropriate, with full indemnity for CONSIGNIAS Y LOCKERS, S.L.

The User will be responsible for the items they place in the lockers.

In any case, the removal of prohibited items will incur a penalty of 300 Euros, which will not exclude the User’s obligation to compensate CONSIGNIAS Y LOCKERS, S.L. for any damages or losses caused.

Damage caused to the lockers and/or premises by Users
The User will be fully responsible for any damage or deterioration caused to the lockers due to improper or inadequate use, as well as any damage to the commercial premises. In such cases, the User must compensate CONSIGNIAS Y LOCKERS, S.L. for physical damages caused to the locker(s) and/or the commercial premises, as well as for any lost profits.

In particular and without limitation, the User responsible for the damage must pay CONSIGNIAS Y LOCKERS, S.L. a daily penalty for each day the locker is rendered unusable, set at 100 Euros per day, as well as the cost of repair or replacement, which is quantified at 1,000 Euros in the case of replacement. This is in addition to any further damages and losses that can be substantiated if they are greater.

Any damage the User may cause to the premises due to improper or inadequate use will incur a penalty of at least 400 Euros, with the possibility of the amount being increased to cover the full cost of the damage, as justified by CONSIGNIAS Y LOCKERS, S.L.

Payment of penalties
The penalties detailed in this section will be paid by the User using the same payment method as the one used by the User when contracting the service, or via bank transfer to the account specified by CONSIGNIAS Y LOCKERS, S.L. if requested by the User. The User expressly agrees that CONSIGNIAS Y LOCKERS, S.L. may charge the amounts established in this section using the card or payment method provided by the User when contracting the service, and will provide, if requested by the User, a breakdown of the expenses incurred and the penalties applied.

Obligations of consignias y lockers, s.l.

CONSIGNIAS Y LOCKERS, S.L. undertakes to keep the locker service active and to make available to the User, for the contracted time, the locker or lockers that the User has rented in good working condition.

Furthermore, CONSIGNIAS Y LOCKERS, S.L. undertakes to resolve any incidents that may arise in the use of the lockers as quickly as possible.

Limit of liability of consignias y lockers, s.l.

CONSIGNIAS Y LOCKERS, S.L. offers a locker space rental service, and is not responsible for the custody of the items. The User is solely responsible for the goods placed in the rented lockers.

In the event of theft, loss, or damage of the items stored, the User must file a report with the relevant authorities.

CONSIGNIAS Y LOCKERS, S.L. provides a 24-hour surveillance service, 365 days a year, which the User expressly accepts. If the relevant authorities require the recorded footage, it will be provided to them as quickly as possible by CONSIGNIAS Y LOCKERS, S.L.

Non-application of these general and specific terms and conditions of business

A person will not be considered a Customer of CONSIGNIAS Y LOCKERS, S.L. and therefore, these General and Particular Terms and Conditions of the contract will not apply to those Users who have not reserved their locker through the means offered by CONSIGNIAS Y LOCKERS, S.L. (web or at the commercial premises, using the provided software).

In particular, the following will not be considered Customers of CONSIGNIAS Y LOCKERS, S.L.:

  • Those who accept the reservation Code provided by another User, whether the User left the locker or intends to share it.
  • Those who leave their items in an open locker without reserving it first and do not call CONSIGNIAS Y LOCKERS, S.L. to resolve the issue.
  • Those who leave their items outside the lockers provided for this purpose.
  • Those who are in the premises for reasons other than reserving and using a locker.

Complaints

If the User believes they have grounds to file a complaint, they can do so by sending an email to the following address info@belockal.com.

CONSIGNIAS Y LOCKERS, S.L will strive to resolve the issue and find a satisfactory solution for both parties.

If the User is not satisfied with the response, CONSIGNIAS Y LOCKERS, S.L offers the option to submit a complaint form to the consumer authorities of the Community of ANDALUSIA. The corresponding form can be obtained through the following link:

Language

The language in which the contract between CONSIGNIAS Y LOCKERS, S.L. and the Client will be formalized is Spanish, even if the Client has chosen any other available language on the touchscreen to navigate through it.

Industrial and intellectual property

The intellectual and industrial property rights over the works, brands, logos, and any other items subject to protection, contained on the Belockal website and in the Belockal commercial premises, exclusively belong to Belockal or to third parties who have authorized their inclusion on the website and/or in the commercial premises. Unauthorized reproduction, distribution, commercialization, or transformation of such works, brands, logos, etc. constitutes an infringement of Belockal’s or the respective rights holder’s intellectual and industrial property rights, and may lead to the exercise of any judicial or extrajudicial actions they may be entitled to in the exercise of their rights.

Additionally, the information that the Client may access through the website and the touchscreen located in the commercial premises may be protected by intellectual, industrial, or other property rights. Belockal shall not be responsible in any case or under any circumstances for any infringements of such rights that the user may commit.

Data protection

While the Privacy Policy is regulated in the “Privacy Policy” section of the website www.belockal.com, the following is provided in these Terms:

In accordance with Organic Law 3/2018 of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (the “LOPD”), we inform you that CONSIGNIAS Y LOCKERS S.L, with NIF B56429723, will be the responsible party for the processing of the personal data you provide within the framework of this Contract.

The personal data processed will be kept for as long as the contractual relationship between CONSIGNIAS Y LOCKERS S.L. and the User is maintained, and thereafter, they will be kept in a blocked form for the necessary time to comply with any applicable legal obligations.

The legal basis for the processing of the data is the execution and management of this contract. The name, surname, phone number, and email address provided by the User will be transferred to Drop Point Systems S.L.U. for managing the reservation.

If your personal data must also be communicated to third-party suppliers, CONSIGNIAS Y LOCKERS S.L. will sign the corresponding data processing agreement with those suppliers, to ensure that your personal data is processed by them in accordance with the requirements and guarantees of the LOPD.

Additionally, the User is informed that data processed through video surveillance will be treated for the purpose that motivated its installation, which is related to ensuring the safety of people, property, and facilities.

These recordings will be incorporated into files owned by CONSIGNIAS Y LOCKERS S.L. or authorized third parties for security purposes and will be kept for the legally established time. They will only be transferred to competent authorities (Judges, Courts, or Law Enforcement) if required or for the defense of the rights of CONSIGNIAS Y LOCKERS S.L. or the Users.

The User may exercise the following rights related to their personal data: Access; Rectification; Deletion; Limitation of processing; Data portability; and Opposition.

The User has the right to file a complaint with the Spanish Data Protection Agency if they deem it appropriate.

Jurisdiction and applicable law

In the event of any conflict or discrepancy in the interpretation or application of these contractual terms, the Courts and Tribunals that, as applicable, will handle the matter will be those determined by the applicable legal provisions regarding jurisdiction, which, in the case of final consumers, considers the place of performance of the obligation or the domicile of the purchasing party.

This is without prejudice to the Client’s right to go to the Consumer Arbitration Board of their jurisdiction.

In the case of a sale made by a company, both parties submit to Spanish law and, with express waiver of any other jurisdiction, to the Courts and Tribunals of Seville (Spain).

If the selected locker is not large enough to accommodate their belongings, the client must acquire an additional locker or a larger one without holding CONSIGNIAS Y LOCKERS S.L. accountable for the error and without demanding a refund of the reservation fee.
